Rulemaking hearing
On April 4, 2023, Employment Security Department filed a CR-102 for Paid Family and Medical Leave rule making. The CR-102 was filed to amend existing rules regarding employer reporting requirements, placement, elective coverage requirements, and designated representatives. The proposed amendments add two requirements for employer quarterly reports. The first is a report of “no payroll” for a maximum of eight consecutive quarters when employers have no paid wages to report. The second is a requirement to add employees’ dates of birth to quarterly wage reports. Proposed amendments also clarify the definition of placement, clarify benefit eligibility for self-employed elective coverage, and clarify provisions that allow designated representatives to file weekly claims. A rulemaking hearing will be held via TEAMs and we encourage anyone interested in the proposed rules to provide testimony.

This is an opportunity for you to voluntarily provide testimony on proposed Paid Leave regulations at a public hearing that is required by law. Attendance is optional. You are receiving this rulemaking notice because ESD is updating the Paid Leave reporting system so employers can report for both Paid Leave and WA Cares programs at the same time.
